1) That automobile your spouse “gave” you for your birthday is not excluded from being a marital asset. Gifts between spouses remain marital property and will be included in the equitable division of your assets.

2) It is entirely lawful to record any telephone conversation that you are a participant in, but only as long as both people are located in the State of Georgia.

3) E-mails, texts, messages and posts made on websites and over social media can be used as evidence against you. You should expect that anything you write will be presented to the court, so be careful what you put into writing.

4) If you have sex with your spouse after filing for divorce, your case will likely be dismissed, and you will be required to start over.

5) In Georgia, when a child reaches the age of fourteen, the child has the right to decide which parent he or she wants to live with, and generally, the court will support the child’s decision.
