Power Morcellator Lawsuit Boom Initiates Government Investigation Of The Product

Tracey & Fox reports on a current investigation of the power morcellator surgical device by the United States Government Accountability Office. A power morcellator, used for gynecological surgeries such as hysterectomies and myomectomies, has also recently been the topic of many lawsuits which allege the device can spread and upstage cancer in patients.

Research done by the United States Food and Drug Administration indicates that the risk of spreading previously undetected uterine cancer by using a power morcellator is about 1 in 350. As lawsuits alleging this exact occurrence continue to appear, lawmakers have requested that the Government Accountability Office should investigate why there was a 20 year delay between the product’s FDA approval, and current FDA warnings stating that for most women, the product should not be used due to cancer risk.

During gynecological surgeries, power morcellators are inserted through a small incision in the abdomen. Once inside, they work much like a drill to tear apart troublesome uterine tissue and uterine fibroids. According to claims, however, as the device is doing this, it can also uncover previously undetected cancer cells, and its tissue-tearing motion can spread these cells throughout the body, causing the patient to be diagnosed with widespread and aggressive cancer post-surgery.

The FDA, which initially approved the device in 1993 issued a new warning in 2014 which informed patients and physicians of the cancer concern. The FDA’s earlier approval process has since been a subject of debate as well, with many concerns that it was not thorough. The FDA approved power morcellators through a 501(k) process, which allows manufacturers to gain faster product approval by showing that their devices are substantially equivalent to ones currently on the market.

Across the nation, lawsuits against power morcellators alleging that the device spread cancer in patients continue to be filed. The cases have since been consolidated to form multidistrict litigation 2652. This consolidation should help to move litigation more quickly, avoiding duplicate discovery and saving money and time for those involved.
